YEALM CABIN TERMS & CONDITIONS

Definitions
Bookings placed with Yealm Cabin form a contract with Yealm Cabin (referred to as 'Yealm Cabin' 'Cabin’ 'us' or 'we'). By placing a booking, you agree to be legally bound by these terms and conditions.

The non-refundable deposit forms 30% of the total rental price of the holiday. The remaining balance forms 70% of the total rental price of the holiday.

Premises means the Cabin, Grounds and Facilities.

1.0 The Guest
1.1 The Guest is the person who makes the booking.
1.2 The Guest must be over the age of 21.
1.3 The Guest is responsible for letting us know how many occupants the cabin will have during your rental period.
1.4 The Guest is responsible for all habitants of Yealm Cabin within your rental period.
1.5 The Guest must notify us of any pets that are staying at the Cabin. Pets will incur an additional fee of £50 per pet per stay.

2.0
The Premises
2.1 The Premises includes all grounds making up Yealm Cabin.

3.0
Occupancy of the Cabin
3.1 The cabin may only be occupied by the guest plus the other persons named at the time of booking.
3.2 The maximum number of persons occupying the cabin in addition to the guest booking is 3. (4 Guests Max)
3.3 Infants and babies count as persons, pets do not count as persons.
3.4 We reserve the right to refuse entry or evict those listed on the booking form if the number of persons occupying the cabin exceeds the maximum permitted numbers. This includes entertaining in the cabin or on the Premises without prior written permission.
3.5 Additional guests above the maximum numbers specified must be agreed in writing by us.
3.6 We reserve the right not to accept bookings from groups of people under the age of 21.
3.7 Smoking is not permitted in the cabin and you will incur a fine if you do smoke inside the premises.
3.8 Arrival is from 4pm (no earlier). Departure is no later than 10am. Early arrival and late departure will incur an additional fee.

4.0 The Contract and Payment
4.1 We reserve the right to reject any booking where a non-refundable deposit has not been received. The guest’s booking only becomes binding when we receive the non-refundable deposit.
4.2 The booking is only secured when the non-refundable deposit is received. The non-refundable deposit forms 30% of the total rental price of the holiday.
4.3 The remaining price is due 8 weeks before the start of the holiday, ‘the due date”. The full holiday price is payable at the time of booking where the holiday starts within 8 weeks of date of booking.
4.4 If you fail to pay on the due date we shall be entitled to terminate the contract without obligation to repay to you any sum already paid.

5.0
Cancellation
5.1 In the event you cancel your booking, we will make all reasonable efforts to re-let the cabin. If the cabin is not re-let there will be no refund. If we do re-let the cabin, you will receive a refund on the remaining balance minus a 30% marketing fee. Please note that the initial 30% deposit is non-refundable and is not included in the remaining balance refund.
5.2 We recommend that you take out cancellation insurance.

6.0
Care of the Premises
6.1 You are responsible for taking good care of the premises and your cabin, its furniture and fitments, leaving it in a clean and tidy order. If an excessive amount of cleaning is required at the end of your stay we will charge you the cost.
6.2 All damage and breakages must be reported to us before the end of your stay. We have the right to make repairs and replace damaged property at your expense.
6.3 If you cause damage which results in any part of the Premises from being in our opinion unfit to let to subsequent guests you shall be liable for the resulting loss of rent and any other related losses.
6.4 Pets must be kept off all furniture at all times. Any damage resulting from pet smells/hairs and stains will be charged for.

7.0
Our Liability
7.1 We shall not be responsible for any loss or damage to any belongings or injuries sustained by you or any member of your party.
7.2 We reserve the right to cancel your booking at any time and in this event our total liability shall be to refund you all sums which you have already paid including your non-refundable deposit.
7.3 Yealm Cabin do not accept responsibility for anything which adversely affects your holiday which is outside of our control. These circumstances are known as 'Force Majeure' events and are circumstances that Yealm Cabin could not, even with due care, have foreseen or avoided. Such circumstances include (but are not limited to) war, civil unrest, industrial action, terrorist activity, natural disaster, fire, adverse weather conditions, foot and mouth disease, epidemic, pandemic and all other similar events outside of our control. Yealm Cabin will endeavour to manage any problems caused as a result of a Force Majeure event but shall be under no obligation to do so and shall not be liable to you for any losses caused by a Force Majeure event.

8.0
Your Responsibility
8.1 The Guest is responsible for the correct and decent behaviour of those occupying the Premises. Should the Guest and those occupying the Premises behave in such a manner that is not acceptable to civilised standards, we reserve the right at our discretion to ask the whole party to vacate the Premises, terminating your stay immediately without any further liability to you. We respectfully request that due consideration is shown to the inhabitants of neighbouring properties and surrounding wildlife and noise is kept to a minimum, particularly at night or in the early morning.

9.0
Complaints
9.1 We aim to maintain the highest standards in running the Premises. In the event that problems do occur you should contact us immediately. Any complaints should be made within 24 hours of any incident giving rise to the complaint and should be notified to us in writing before your departure. If this procedure is not followed we will not consider any claim under any circumstances. But we hope you will never have cause to complain.

10.0
Access to the Premises
10.1 You must allow us and our agents (i.e. gardeners, hot tub supervisors etc.) reasonable access to the premises. We will endeavour to give you reasonable notice if we need to access the inside of the premises.

11.0
HOT TUB

You and your party are reminded that you are responsible for your own safety whilst using the hot tub. All reasonable care must be taken and all rules/conditions of hire must be obeyed. Failure to observe these rules may result in the hot tub being closed immediately for safety reasons. Every effort will be made to keep the hot-tub open at all times however, as it takes 24 hours to change and reheat the water there may be occasion when it has to be closed due to maintenance or misuse. This could be during your stay if the water needs to be cleaned or replaced. Please note that in order to maintain the best levels of hygiene, your hot tub will have been refilled on the day of your arrival. It will not always be fully warm for comfortable use until the late evening/following morning of your arrival.

CONDITIONS OF HIRE

11.1 Any guests with health concerns MUST consult their GP before using our hot-tubs. Particularly persons suffering from diabetes, obesity, heart disease and cardiovascular conditions, low/high blood pressure, circulatory problems and so on. People with skin, ear, genital or other body infections, open sores, or wounds should not use the hot tub because of the possibility of spreading infection or irritating your condition.
11.2 Any guests using medication MUST consult their GP before using our hot-tubs, particularly medicines that are likely to cause drowsiness, affect heart rate, circulation or blood pressure.
11.3 Guests taking medication that can cause drowsiness (such as tranquillisers, anti-coagulants, anti-histamines and so on) MUST NOT use our hot-tubs.
11.4 Pregnant women are strictly forbidden from using the hot-tub for their own safety as well as that of their baby. During pregnancy soaking in the hot tub may cause damage to the foetus.
11.5 Any guest using our hot-tubs with conditions mentioned in terms 11.1 - 11.4 does so at their own risk. Yealm Cabin will NOT accept any liability for any illness or injury sustained during use against this advice. If in any doubt, guests should consult their GP prior to use.
11.6 Never use the hot tub alone.
11.7 Do not immerse your head in the hot tub water.
11.8 Children using the hot-tub must be over 12 years of age and supervised by a responsible adult at all times. Children should stay in the hot tub no longer than five minutes. Parents should warn children not to allow water in their mouths as this may cause illness.
11.9 DO NOT PUT BUBBLE BATH, WASHING-UP LIQUID, SOAP, PERFUMES OR ANY OTHER CHEMICALS IN THE HOT-TUB. THIS MAY RESULT IN A CHEMICAL REACTION THAT COULD CAUSE HARM TO USERS.
11.10 When not in use, make sure the cover is on in order to eliminate the risks for children and pets. Pets are forbidden from ever entering the hot tub and ignoring these rules will result in instant dismissal from Yealm Cabin. Water testing will determine whether these rules have been adhered to.
11.11 Don’t use the hot tub immediately after a meal.
11.12 Avoid entering the hot tub water immediately after exercising as the water temperature can affect the heart rate.
11.13 Please be aware that the area surrounding the hot-tub can become slippery when wet, due care and attention is advised. Yealm Cabin will accept no liability for any slips, trips or falls due to the aforementioned conditions. Also, please do not jump into or out of the hot-tub.
11.14 Guests must NOT eat, smoke or consume alcohol whilst in the hot-tub.
11.15 Guests MUST NOT use glassware in or around the hot-tub
11.16 Do NOT use any electrical equipment in or around the hot-tub, including mobile telephones. An exclusion zone of five feet is advised.
11.17 Before use, please carefully remove the hot-tub cover and replace it after use as per instructions provided in the cabin. Failure to follow these guidelines will incur an extra cost for additional water heating or any damage.
11.18 Guests using hot-tubs MUST shower prior to use. This prevents any foreign particles or chemicals (such as deodorants, body lotions & fake tan) entering the hot-tub that could upset the water chemistry and sanitisation process. Guests also agree to ensure that NO foreign materials enter the hot-tub (such as grass and soil); this ensures that the hot-tub will be enjoyable and achieve maximum performance. Ignoring these rules will result in the hot tub being drained and closed for the duration of your stay.
11.19 The hot-tubs are preset to the optimal temperature of 37C. Guests may find that this fluctuates slightly during periods of very warm/cold weather. Should the temperature rise above 37C it is recommended that guests do not spend more than 15mins in the hot-tub at any one time. Guests must stick to these temperature guidelines and ensure the hot tub is set to 37C at all times as checks will be made. Never enter the hot tub if the temperature exceeds 40C. Parents are advised to never let their children in temperatures that exceed 35C and to limit there bath to no longer the 5 minutes due to internal overheating.
11.20 Guests MUST ALWAYS check the water temperature prior to using the hot-tubs, especially when children are in the party.
11.21 Guests must allow staff access to keep the hot tub sanitised on a regular basis. Any misuse of the hot tub or if the water has become dirty due to misuse will result in draining and closing the hot tub for the duration of your stay.
11.22 Guests MUST NOT allow the hot-tub water level to fall below the uppermost jets; this can damage the pump.
11.23 Please do not over load the hot-tub; this may cause damage for which guests would be liable. Maximum occupancy is 4 people.
11.24 Any damage cause by misuse or non-compliance with the conditions of hire WILL BE PAID FOR BY THE GUEST.
11.25 Guests will read and abide by these conditions. If anything is unclear or there is cause for concern, guests should contact us immediately on the numbers provided.

By placing your booking with us you indemnify Yealm Cabin from all liabilities incurred whilst using the hot tub during your stay.
